While purchasing foreclosed properties is a familiar concept in many parts of the world, such opportunities in Israel—and especially in Jerusalem—are relatively rare due to the country’s distinct legal and financial frameworks.
In Israel, the foreclosure process operates differently than in countries like the United States. Foreclosures typically arise from unpaid debts or mortgage defaults. However, these instances are less frequent in Israel, which means foreclosed properties appear less often on the open market.
Beyond traditional real estate channels, some properties in Jerusalem are sold through a court-appointed receiver—often a lawyer—when an owner defaults on financial obligations. The court assigns the receiver (כונס נכסים) to handle the property’s sale in order to repay outstanding debts. These sales can present unique buying opportunities, sometimes at more attractive prices than those found through conventional listings.
When a property falls under receivership, the appointed receiver manages the entire sales process. This typically includes organizing designated viewing times for prospective buyers. After the viewings, interested parties can submit offers. The receiver then reviews the bids and often requires court approval before completing the sale. This process is designed to be transparent and to ensure the property is sold at a fair market value.
Purchasing a property through a receiver can offer the advantage of below-market pricing. However, it also requires careful due diligence. Buyers should thoroughly inspect the property and verify its legal status. Working with a real estate attorney who specializes in Israeli property law is highly recommended to ensure a smooth and legally sound transaction.
Although foreclosures are not widespread in Jerusalem, the sale of properties via receivership presents a real, if niche, opportunity in the local market. With proper legal support and a clear understanding of the process, these types of transactions can be both rewarding and worthwhile.
